(Political Theory)
Political theory is a branch of political science that deals with the systematic study of political ideas, values, institutions and practices. It provides systematic knowledge of political phenomena and helps us understand how power, authority, justice, liberty, equality and rights operate in society. It is both descriptive (explains political realities) and normative (evaluates what ought to be).

(Decline and Resurgence)
Decline of Political Theory: The decline of political theory was most visible during the 1950s and 1960s in Western political science, particularly in the United States. This was due to the behavioural revolution in political science. It means political science shifted towards the scientific, empirical and quantitative study of politics. Instead of normative “what ought to be,” scholars emphasised “what is.”
David Easton (1951) in his essay *The Decline of Modern Political Theory* argued that political theory had lost its relevance because it failed to provide meaningful solutions to real-life political problems.
- Reasons for decline: Excessive focus on empirical and scientific methods, ignoring values, philosophy and ethics. Growing belief that political theory is utopian, speculative and abstract. Rise of quantitative techniques and sociology reduced interest in normative theory.
- Thinkers Supporting Decline: David Easton (Criticised traditional political theory for being unscientific), Peter Laslett (Declared “Political theory is dead” in 20th century), Reimer (Referred to political theory as being “in the doghouse”), Robert Dahl (Advocated behaviouralism and empirical political science), Alfred Cobban (In his book “The Decline of Political Theory” (1960s)).
Context of Resurgence: Civil rights movements, feminism, decolonisation, student protests and Vietnam War revived normative concerns. Scholars realised that political questions cannot be answered only through data and statistics; issues of justice, rights, freedom, equality are central to politics.
- Key Thinkers: John Rawls (A Theory of Justice, 1971) revived normative political philosophy by focusing on ‘justice as fairness’. Robert Nozick (Anarchy, State and Utopia, 1974) brought liberal-libertarian debates. Revival of Marxism, Feminism, Post-colonialism added fresh normative and critical perspectives.
- Resurgence of Political Theory: World War II and the Cold War increased interest in policy-oriented, practical studies, rather than abstract theorising. From the late 1960s onwards, political theory experienced a revival. David Easton himself later called for the revival of political theory because empirical political science had failed to answer questions about values, justice, liberty and authority.

(Liberty)
The word liberty is derived from the Latin word ‘Liber’ which means free. Initially, liberty was understood as the absence of restraints. In modern political science, liberty is regarded as one of the core political values. It means the condition in which an individual is free from unnecessary external restrictions and has the opportunity to develop his/her potential. It is central to democracy, rights, justice and equality. However, liberty does not mean absolute freedom (anarchy) but freedom within a system of laws that ensure social order. Example, In a democracy, you have the liberty to express your opinion, but not to incite violence.
(Evolution of the Concept)
- Ancient Greece: Liberty meant the right of citizens (not slaves/women) to participate in the affairs of polis. It was a primarily political liberty.
- Medieval Age: Liberty was linked with privileges granted by kings or feudal lords (not universal).
- Renaissance and Enlightenment (16th-18th c.): Thinkers like Locke, Rousseau connected liberty with natural rights and individual freedom.
- 19th Century Liberalism: Liberty came to mean economic freedom (free trade, private property, limited state).
- 20th Century onwards: Liberty expanded to include social and economic dimensions like education, health, equality of opportunity (welfare state). Hayek in his work ‘The Constitution of Liberty’ regards liberty and freedom as of same meaning.
(Various Thoughts)
- Martin Luther: He opened the door to claims of public respect for Liberty of Conscience and eventually freedom of worship. In the 17th century, the theme of religious liberty became more pronounced.
- T.H. Green: He emphasised the positive aspect of freedom noting: “It is a positive power of doing or enjoying something worth doing or enjoying” – Moral Freedom.
- Spinoza: He argued for the right to liberty of thought and belief without interference from the sovereign’s power. His ideas about liberty laid the groundwork for democratic ideas in modern political thought. He challenged the Hobbesian principle for not being liberal in spirit.
- Hobbes: According to Hobbes, liberty is about the absence of external obstacles, but it requires a powerful sovereign to maintain order and prevent chaos.
- Rousseau: “Freedom is obeying laws that reflect the general will of the political community.” For Rousseau, liberty is not simply the absence of interference, but the active participation in shaping laws that reflect the collective will.
- Friedrich Hayek: He wrote about freedom as the condition in which individuals are able to act according to their own judgement, within a framework that prevents arbitrary interference from others.
- John Locke: He argued: “A free man is he who, in those things that he is able to do, is not hindered by others in doing what he wills.”
- John Seeley: “Liberty is the opposite of over government”.
- Laski: “Liberty is the product of rights; rights provide conditions in which liberty can flourish”.

(Two Concepts of Liberty)
Isaiah Berlin (1958) drew an influential distinction between two concepts of liberty, which he called negative liberty and positive liberty.
- Negative Liberty: Refers to the absence of obstacles, barriers or constraints imposed by others. It is about non-interference, where an individual is free to act as they wish without being prevented by others.
- Nature: Focus on Individual Autonomy: It emphasises the personal autonomy, where individuals are free to pursue their own interests without external control. Limited Government Intervention: Advocates for minimal state intervention as any interference is seen as a limitation on freedom.
- Freedom from Coercion: Concerns freedom from coercion, whether by government, institutions or other people.
- Examples: Freedom of speech, freedom of religion, and the right to privacy are examples of Negative Liberty.
- Exponents: Jeremy Bentham, James Mill, John Stuart Mill, Henry Sidgwick, Herbert Spencer, John Locke, Thomas Hobbes, Isaiah Berlin.
- Positive Liberty: Refers to the ability to act in such a way as to take control of one’s life and realise one’s fundamental purposes.
- Nature: It is about self-mastery and the capacity to be one’s own master, making choices that lead to self-fulfilment.
- Focus: Focus on Collective and Personal Empowerment: Emphasises the role of societal and individual conditions in enabling people to achieve their true potential. Support for Active State Role: Often justifies a more active role for the state in providing education, healthcare, and economic opportunities.
- Freedom to Act: Concerned with creating conditions that allow individuals to act on their free will and make meaningful choices.
- Potential for Authoritarianism: Berlin warned that the pursuit of Positive Liberty can sometimes lead to authoritarianism if it is used to justify coercion or control in the name of achieving collective goals.

(Views of Thinkers)
- John Stuart Mill: According to Mill, liberty consists in doing what one desires, which means the absence of external constraints. For Mill, liberty is inseparable linked with individuality. It means self-development and the expression of free will. He stresses on absolute liberty of conscience, belief and expression which is crucial for human progress. In his book On Liberty, Mill primarily argued that liberty is essential if a state composed of civilised people is to be legitimised.
- G.W.F. Hegel: Hegel refers to ‘freedom realised’ as ‘the absolute end and aim of the world’. Freedom is both the substance of right and its goal, while the system of right is the realm of freedom made actual.
(Table)
| Feature | Negative Liberty (Freedom from…) | Positive Liberty (Freedom to…) |
|---|---|---|
| Core Idea | The absence of external constraints, interference or coercion by other people (especially the state). | The presence of conditions and the capacity to act, develop one’s own potential, and become one’s own master. |
| Guiding Question | “How much is my activity blocked by others?” | “Who (or what) is in control of my actions?” |
| Focus | Individual autonomy. | Self-mastery, empowerment, achieving a “higher self”. |
| Role of State | Minimal. The state’s job is to protect you from interference (e.g., theft or assault) but should otherwise stay out. | Active. The state may need to provide resources (like education, healthcare) so that individuals can be free to live a positive, fulfilling life. |
| Example | You have a car; if you buy a car, it no law stops you to buy a car. | You only have positive liberty to buy a car if you also have the money to do so. |

(Types of Liberty)
- Natural Liberty: Refers to the absolute freedom that individuals possess in a hypothetical state of nature. It exists without any external restrictions or social regulations. It is considered impractical in modern society because unlimited freedom leads to conflict and insecurity. Social contract thinkers argued that natural liberty must be surrendered partially to create a stable and orderly society.
- Civil / Civic Liberty: Refers to the freedom individuals enjoy as members of an organised society regulated by law. It ensures that individuals act freely within the limits defined by the legal system. It includes personal, political, economic, religious and social freedoms granted by the state. It represents the most realistic and widely accepted form of liberty in modern democracies.
- Personal Liberty: Refers to the freedom of an individual in their private and personal life. It protects individuals from arbitrary arrest, unlawful detention and physical coercion. It includes the right to privacy, free movement and bodily integrity. It ensures that individuals exercise autonomy without interference from the state or others.
- Political Liberty: Refers to the rights that enable individuals to participate freely in the political process. It includes the right to vote, contest elections and form political associations. It allows citizens to criticise the government without fear of punishment. It strengthens democratic governance by ensuring active public participation.
- Economic Liberty: Refers to the freedom of individuals to choose their occupation, trade and means of livelihood. It allows individuals to acquire, own and utilise property without unreasonable restrictions. It opposes excessive state control that limits economic decision-making. It promotes economic growth by allowing individuals to pursue their financial interests.
- Moral Liberty: Refers to the freedom of individuals to act according to their conscience. It involves the ability to distinguish between right and wrong and to act ethically. It encourages individuals to develop their moral character. It supports ethical decision-making in a civilised society.
- National Liberty: Refers to the freedom of a nation from foreign domination or external control. It involves the right of a people to govern themselves independently. It is closely associated with nationalism and the principle of self-determination. It strengthens national identity and political sovereignty.

(Contemporary Ideas)
- Milton Friedman (1912-2006): Like J.S. Mill and Isaiah Berlin, was a liberal who in his work Capitalism and Freedom (1962) developed liberty as a significant aspect of capitalist society. He emphasised freedom of exchange as an essential aspect of liberty. To promote this freedom, Friedman argued that the state must give up its concern for welfare and social security and restrict itself to maintaining law and order, property rights and contract enforcement. For Friedman, liberty was both a precondition for and a product of free and voluntary exchange, achievable only within a capitalist society.
- F.A. Hayek (1899-1992): In The Constitution of Liberty (1960), Hayek propounded a theory of liberty that emphasised the negative role of the state. For Hayek, liberty exists when the individual is not subject to the arbitrary will of another person or authority. He distinguished individual liberty from other forms of freedom (e.g., political freedom), establishing its primacy. He recommended preserving the original meaning of liberty as absence of restraint. Enlarging state intervention in the name of freedom would destroy real liberty which is freedom from external constraints.
- Erich Fromm (1900-1980): Fromm explained that modern societies create openness and alienation due to the separation of individuals from their creative capacities and social relations. This separation generated both physical and moral alienation, damaging mental well-being. He argued that only through creative and collective work could the individual restore his connection to society.
- Marxist Concept of Freedom/Liberty: Marx analysed the concept of freedom against the background of socio-economic conditions. Marxism does not accept the theory of an atomised, alienated and possessive individual being capable of enjoying freedom. Marx pointed out the alienation of man as the most prominent dehumanising effect of capitalism. Communism abolishes all human faculties and qualities of the conditions created by the private ownership of capital and property. Marxist theory thus, envisages the transformation of the capitalist system itself to secure the conditions of freedom.

(PYO Point)
- Carole Pateman’s Argument: Social contract theory (Hobbes, Locke, Rousseau) conceals a deeper sexual contract regulating men’s relationship with women. The original contract created not only civil society but also a patriarchal society, where men enjoyed sexual access to women. This led to men’s freedom and women’s subjection. Civil freedom remains a masculine attribute, excluding women. Greek society (5th-8th century BC), women were the slaves, and thus valued freedom as the opposite of slavery, and Pateman’s view first emerged in women’s consciousness in Ancient Greece.

- Feminist thinkers argue that traditional political theories of liberty were created from a male perspective and systematically excluded women from real freedom. In early Greek society (5th-8th century BC), women were the slaves, and thus valued freedom as the opposite of slavery.
(Equality)
Equality, like liberty is a core political ideal of the modern world. Equality means the principle that all individuals, despite their differences, are entitled to equal rights, opportunities and treatment. French Revolution (1789) upheld liberty, equality, fraternity as guiding principles. Liberty and equality together symbolise human emancipation, justice and resistance against oppression. While complementary in some contexts, they may also appear contradictory, making it essential to grasp the true nature of equality.

(PYO Point)
- Kant’s Moral Philosophy: Categorical Imperative Equality is in the idea of universal human worth. His idea of autonomy and self-legislation recognised equal freedom for all rational beings, laying the basis for human rights.
- Principle of Equal Dignity and Respect: Fundamental rule Equals should be treated equally in like circumstances and unequals unequally. Became a minimum moral standard in Western thought.
- Shift in the 18th Century: Humans are naturally unequal, leading to hierarchies. Changed with the idea of natural rights → recognition of substantive, universal, moral equality. Rooted in belief that all humans are children of God, hence equal before God.
- Dworkin’s View (Modern Perspective): Moral equality means treating persons as equals, with equal concern and respect. Does not mean treating all persons equally in every circumstance. This idea of equal dignity and worth is now accepted as a minimal standard in modern Western political and moral culture.

(Dimensions of Equality)
- Legal Equality: The principle of equality was initially put forward as the demand for legal equality grant of equal legal status to all individuals in society irrespective of any difference. J.J. Rousseau, in his theory of Social Contract (1762) believed that legal equality to all citizens is the primary characteristic of civil society.
- Key Features: The idea of legal equality thus emanates from moral considerations and serves as the basis of equal rights of men. Equality of law implies equal access to law. Legal equality implies equal subjection of all citizens to the law and equal protection of the law for all citizens. Legal equality creates formal equality.
- Political Equality: It implies equal political rights for all citizens. Based on the idea that individuals are rational beings, capable of political judgement despite social or economic disparities. Assumption Equal political rights promote the common good.
- Components: Democratic rights of the people. Universal franchise (right to vote for all adults). Equal freedom to hold and express political opinions without fear or favour. Equal rights to form associations and influence political decisions.
- Robert Dahl’s Criteria for Political Equality: According to Robert Dahl, only a Democratic Government Ensures Political Equality. His five criteria are as follows:
- Voting equally Every vote has equal weight.
- Effective participation Equal opportunity to express preferences.
- Enlightened understanding Equal access to information and deliberation.
- Control of the agenda Citizens can influence which issues are decided.
- Collective Decision-making Inclusion of all adults in collective decision-making.
- Consequences and Extensions: Political equality has led to demands for socio-economic equality. According to Alexis de Tocqueville (Democracy in America), the demand for equality evolved in phases:
- First phase demand for political equality.
- Second phase demand for social and economic equality.
- Rise of socialist ideas encouraged socio-economic equality through socialist thoughts.

(Formal & Substantive Equality)
Formal Equality
Treating everyone equally, without favouritism or discrimination, regardless of their differences.
- Key Features: ‘Equality before the law’ or ‘equal treatment.’ Emphasises uniform application of rules and laws. Does not account for existing inequalities in society (e.g., socio-economic disparities).
- Examples: Everyone has the right to vote irrespective of caste, gender or religion. Uniform application of rules in public exams or recruitment.
Substantive Equality
Goes beyond formal and legal equality by addressing the root causes of inequality to ensure equitable outcomes.
- Key Features: Focuses on equality of opportunity and equality of outcomes. Recognises structural barriers and advocates affirmative action to overcome them. Often involves redistributive measures to level the playing field.
(Social and Economic Equality)
- Social Equality: This is a state of affairs in which all individuals within a society have the same status, rights and liberties. It insists that no person should be less privileged or face discrimination on the grounds of arbitrary factors like race, gender, religion, caste or class.
- Key Thinker Simone de Beauvoir: In her book The Second Sex (1949), she analysed how society, culture and law are structured to treat women as ‘the Other,’ creating profound social inequality regardless of their legal or economic standing.
- Economic Equality: This concept is concerned with the distribution of material resources, wealth and income. It can range from a strict ideal of equality of outcome (everyone has the same) to a more common goal of reducing disparity (narrowing the gap between the richest and poorest) and ensuring equal economic opportunity.
- Key Thinker Karl Marx: In Capital (Das Kapital, 1867), he argued that the capitalist system is inherently built on the exploitation of the working class (proletariat) by the ownership class (bourgeoisie), leading to extreme and unjust economic inequality.

(Equality of Opportunity vs. Outcome)
- Equality of Opportunity: John F. Kennedy (1963) stated, “All of us do not have equal talent, but all of us should have an equal opportunity to develop our talents.” Equality of opportunity means giving everyone the same chance to compete, though the system remains hierarchical. It is based on merit, where distinctions arising from talent, skills and hard work are seen as morally justifiable. It requires removing obstacles that prevent personal self-development, ensuring that careers are open to talent and promotions are based on ability rather than status, family background or social connections. This principle is institutionalised through fair access to opportunities, careers open to talent and measures like positive discrimination. However, equality of opportunity is limited because it sustains inequality in outcomes and creates an artificial separation between the successes and failures of one generation and the next.
- Equality of Outcome: Defenders of equality of outcome believe that the guarantee of all other equalities would be inadequate so long as equality of outcome is not ensured. The drive for equality, it is argued, is at the cost of individual liberty. Marx argued for absolute social equality, possible only if private property was abolished. Marx was of the opinion that any right to equality circumscribed by a bourgeois economy can only be partial. F.A. Hayek has argued people being very different have different aspirations and goals and any system that treats them equally actually results in inequality.

(Justice)
Meaning of Justice: Justice is one of the core concepts of political philosophy, moral philosophy and law. It deals with the question: What is the fair and right way of arranging human relations, distributing resources and resolving conflicts? The word justice is derived from the Latin words jungere (to bind or to tie together) and jus (a bond or tie). Justice essentially means fairness, equality and impartiality in distribution of rights, duties, rewards and punishments.
- Cicero: “Justice is a habit of giving everyone their due.”
- John Rawls (Harvard University): In A Theory of Justice (1971) defined justice as “the first virtue of social institutions.” His work marked the beginning of a golden age in theorising about justice.
- Tom Campbell: Described justice as “the central and commanding concept of current mainstream normative political philosophy.”
(PYO Point)
- Plato’s concept of justice: Famously in The Republic, defines it as harmony where each person and social class (rulers, warriors, producers) performs their specialised role perfectly. It embodies ‘one man, one work; one class, one duty,’ creating a unified, functional society where duties to the state and internal soul balance, rather than emphasising individual rights.

- Socrates Opinion: Socrates believed that justice does not mean doing good to our friends and harm to our enemies, nor is it merely the pursuit of one’s own interests. According to him, justice is concerned with the overall welfare and harmony of all individuals in society.
- Plato’s Concept of Justice (The Republic): Justice is “each one performing their own role and not interfering in others’ roles” – the principle of specialisation. In an individual, justice exists when reason, spirit and appetite perform their proper functions in harmony. Each part of the soul has a specific role, such as Reason Guides the individual with wisdom. Spirit Supports reason with courage. Appetite Obeys reason and remains disciplined. Justice in the state mirrors justice in the individual, achieved when rulers govern with wisdom, auxiliaries (warriors) enforce order and protect state or producers (farmers, artisans) provide for material needs of society. Injustice arises from role confusion, where one part of the soul or class tries to dominate the others. Thus, for Plato, justice is harmony and proper order, both within the soul and in society.
- Aristotle’s Concept of Justice: Aristotle argued that equals should be treated equally, and unequals should be treated unequally in proportion to their merits and contributions. He believed that each individual should receive justice according to their position, ability and the nature of their work. PYO Point: According to Aristotle, “Distributive justice is mainly concerned with the fair distribution of honours, wealth and other social goods in proportion to merit.”
- Types of Justice:
- Legal Justice: Concerned with obedience to laws and upholding rights in society. Ensures that everyone is subject to the same laws and violations are punished fairly. Focuses on maintaining law and order, protecting citizens from harm and resolving disputes impartially.
- Political Justice: Related to the distribution and exercise of political power. Ensures fair participation in governance and decision-making. Guarantees equal rights in political processes, such as voting, representation and accountability of rulers.
- Social Justice: Focuses on equality of opportunity, rights and treatment within society. Seeks to eliminate discrimination based on class, caste, gender, race or religion. Aims at creating fair social institutions and promoting access to education, healthcare and social welfare.
- Economic Justice: Concerns the fair distribution of wealth, income and resources. Ensures that individuals receive rewards proportional to their contribution while safeguarding the least advantaged. Balances freedom of enterprise with measures to reduce inequality and poverty, often through taxation and social programmes.
- Principles of Justice (Aristotle):
- Equal Treatment for Equals: This concept was introduced by Jeremy Bentham. It is also known as Democratic Justice or Numerical Justice. According to this principle, the resources of a country, along with rights and freedoms, should be equally distributed among all members of society and no one should be discriminated against on the basis of caste, class, gender or race.
- Proportionate Justice: This principle emphasises that equals should be treated equally and unequals should be treated unequally, based on their abilities and contributions. Each individual should receive justice according to the nature and value of their work.
- Recognition of Special Needs: The Indian Constitution recognises the special needs of certain sections of society. It allows for reservations in government jobs and educational institutions for people belonging to the Scheduled Castes (SCs) and Scheduled Tribes (STs) to promote social equality and justice.

(Procedural and Substantive Justice)
| Aspect | Procedural Justice | Substantive Justice |
|---|---|---|
| Definition | Justice as fairness or impartiality of the processes and procedures through which decisions are made. | Justice or fairness of the content or outcome of laws, policies or decisions. |
| Focus | Concerned with how decisions are reached. | Concerned with what decisions and outcomes are. |
| John Rawls’ View | Advocated pure procedural justice – fairness of outcomes depends solely on fair procedures. | Not directly Rawlsian; focuses on needs-based or value-based fairness in outcomes. |
| Examples | Fair trial, running race, lottery – outcome is just if the procedure is fair. | Laws on abortion, drug use, welfare distribution – judged as just/unjust based on societal values. |
| Legal Systems | Just when rules are impartially followed and consistently applied. | Just when outcomes/content of law align with moral and cultural values of society. |
| Objectivity vs. Subjectivity | More objective – can be assessed by checking fairness of process. | More subjective – varies across individuals, groups, societies and time periods. |
| Key Idea | “Justice is seen to be done” by ensuring fair procedures. | Justice depends on what is decided, reflecting moral pluralism and social values. |

(John Rawls’ Theory)
- John Rawls’ A Theory of Justice (1971) is considered a landmark in contemporary political philosophy. It revitalised debates on justice, fairness and equality in democratic societies.
- Rawls aimed to provide an alternative to utilitarianism, which dominated much of earlier political thought.
- PYO POINT: In John Rawls’ theory of ‘Justice as Fairness,’ the principles of justice flow from a hypothetical ‘Original Position’. The idea originates from a conceptual, not historical, starting point (Original Position) where people choose principles for society.
- Relevance of the Theory: Deals with equitable distribution of resources in society. Focuses on primary goods like rights, liberties, opportunities, income and wealth that every rational person is presumed to want. Provides a philosophical basis for addressing modern issues such as inequality, poverty and fair opportunities.
- Core Philosophy: Rawls’ theory states the following concept: The right is prior to the good. Justice must be defined independently of individual or societal notions of ‘good life.’ Justice is the virtue of social institutions, not merely of individual actions. A just society is one where the basic structure of society (laws, institutions, social arrangements) is just.
- Rawl’s Principles of Justice:
- Liberty Principle: Each person has an equal right to basic liberties (freedom of speech, conscience, political rights, etc.).
- Difference Principle: Social and economic inequalities are justified only if: They benefit the least advantaged members of society. Positions of advantage are open to all under conditions of fair equality of opportunity.
- Original Position and Veil of Ignorance: Rawls proposes a thought experiment to derive principles of justice. Individuals choose principles of justice from an ‘original position’ behind a ‘veil of ignorance’ (i.e., without knowing their class, status, talents or social position). Ensures impartiality and fairness, since no one can design rules to favour their own advantage.
- Key Contributions: Justice as fairness becomes the guiding idea. Offers a middle path between unregulated capitalism and extreme socialism. Shifts focus from utility-maximisation (utilitarianism) to rights and fairness.

(Criticisms)
| Thinker / School | Work | Main Criticism of Rawls |
|---|---|---|
| Robert Nozick (Libertarian) | Anarchy, State and Utopia (1974) | Rawls’ difference principle violates individual liberty. Redistributive taxation is forced labour. Property rights should be absolute. |
| Communications (Michael Sandel, Charles Taylor, Alasdair MacIntyre) | Various works (e.g., Sandel’s Liberalism and the Limits of Justice) | Rawls’ original position is based on an abstract, isolated individual. Humans are socially embedded beings. Justice cannot be detached from community traditions and values. |
| Marxists | General Marxist critique | Rawls accepts private property and market economy, ignores structural inequalities of capitalism. Seen as a liberal reformist, not radical enough. |
| Susan Moller Okin (Feminist) | Justice, Gender and the Family (1989) | Rawls ignored gendered division of labour in the family. Family is not neutral, perpetuates gender inequality. Veil of ignorance should include awareness of gender relations. |
| Amartya Sen | The Idea of Justice (2009) | Rawls focuses on ‘ideal theory’ (perfectly just society), neglecting real-world injustices. Proposed capability approach: justice is expansion of real freedoms and capabilities, not just distribution of primary goods. |

(Global Justice)
- John Rawls’s The Law of Peoples (1999) is a particularly significant work that greatly influenced modern thinking on various models of global justice. Theories of global justice aim to help us better understand the world and define our moral responsibilities within it.

(Global Justice & Other Perspectives)
- Global justice is situated within the broader school of cosmopolitanism, which emphasises the moral worth of the individual over that of the state, community or culture.
- According to Thomas Pogge, states alone cannot achieve global justice. He argues that “It has never been plausible that the interests of states- that is, the interests of governments- should furnish the only considerations that are morally relevant in international relations.”
- These approaches often rely on a thought experiment similar to Rawls’s ‘veil of ignorance,’ which asks whether an individual- without knowing their position in society in terms of wealth, merit or genetics- would regard a given global order as just.
- Three primary approaches to global justice are as follows:
- Cosmopolitanism: Advocates that all individuals have equal moral worth and that global obligations and rights should transcend national boundaries.
- Communitarianism: Argues that justice is rooted in specific communities and cultures and that global norms must respect local traditions and values.
- Neorealism: Emphasises state interests, power and security, viewing justice as secondary to the pursuit of national survival and self-interest.
- Justice as Entitlement : Robert Nozick: Anarchy, State and Utopia (1974) is Nozick’s response to Rawls’ distributive theory of justice. It rejects patterned/distributive theories (like Rawls). It proposes an unpatterned, historical theory of justice called the Entitlement Theory.
- Three Principles of Entitlement:
- Principle of Just Acquisition of Holdings: A person is entitled to what they acquire through their own efforts in a just way. Anything acquired honestly and fairly belongs to the individual.
- Principle of Just Transfer of Holdings: If a person acquires holdings through a voluntary transfer from someone else entitled to it, the acquisition is just. Theft, coercion, fraud and even taxation are unjust (since they are involuntary). Voluntary contracts, exchanges or gifts are just transfers.
- Principle of Rectification of Injustice: No one is entitled to a holding except by just acquisition or transfer. If past injustices (like theft or fraud) occurred, they must be rectified to restore justice.
- Three Principles of Entitlement:
- Contrast with Rawls:
- Rawls: Justice requires redistribution of resources based on two principles (equality and difference principle) agreed in the original position behind the veil of ignorance.
- Nozick: Redistribution is unjust unless holdings were acquired or transferred unjustly. Only unjust holdings can be redistributed.
- Communitarian Perspective of Justice : Michael Walzer: Walzer’s key work Spheres of Justice (1983) is based on distributive justice. Justice is pluralistic, not universal; different social goods require different principles of distribution. Conceptions of justice vary across communities, societies and historical contexts; no single universal principle applies. Society consists of multiple spheres (politics, education, health, religion, economy), each with its own rules and social meanings. Humans are socially embedded, shaped by communities and traditions; justice emerges from communal values, not abstract individual rights. Walzer’s critique of liberal theories like Rawls’, emphasising that justice is contextual, plural and community-based.
- Feminist Conception of Justice : Susan Moller Okin: Justice, Gender and the Family (1989) integrates gender and family into the discourse on justice. Liberal theories (e.g., Rawls) are gender-blind, ignoring the role of gender and family and thus fail to address women’s inequalities. Ignoring gender issues perpetuates systemic injustice; traditional roles, socialisation and legal neutrality reinforce women’s subordination. Okin calls for policies addressing domestic inequality, equal division of household work and institutional reforms to make family life gender-just. The gender system institutionalises sex differences, limiting women’s rights and opportunities, with the family shielded as a private sphere from justice scrutiny. Historically, thinkers from Plato to Bentham confined women to the household, leaving justice conceptualised only in the public/political sphere. Okin expanded the debate on justice to include gender relations, the family sphere, domestic labour, caregiving and role equality, bringing feminist critique into mainstream political philosophy.

(Amartya Sen’s Theory of Justice)
Amartya Sen’s Theory of Justice: Amartya Sen’s theory of justice, presented in “The Idea of Justice” (2009), emphasises practical solutions to real-world injustices over abstract ideals.
- Key Features of the Amartya Theory of Justice:
- Public Reasoning: Justice requires open democratic discussion to reflect diverse values and priorities. Sen rejects the idea of a single universal theory of justice, advocating for context-specific solutions.
- Global Justice: Unlike Rawls’s focus on national justice, Sen addresses global issues like poverty and climate change, requiring international cooperation.
- Comparative Approach: Justice is seen as relative, focusing on reducing inequalities by comparing real-world scenarios. Example: In a famine, immediate food distribution takes precedence over long-term structural reforms.
- Capability Approach: Justice involves enhancing individual capabilities; their actual freedoms to lead meaningful lives. Redistribution of resources is important but must translate into real opportunities, like education and healthcare access.
- Critique of Transcendental Theories: Sen criticises traditional theories like Rawls’s, which focus on defining a perfectly just society through abstract principles. He argues for addressing tangible injustices rather than seeking unattainable perfection.
- Practical Implications: Amartya Sen’s theory of justice emphasise on reducing inequalities by improving capabilities, empowering marginalised groups and fostering public reasoning.
